Terms and Conditions (T&C)

1. Scope

These Terms and Conditions apply to all orders placed through the Poké Faust online store. Any conflicting or additional terms of the customer shall not apply unless expressly agreed to in writing by Poké Faust.

2. Offer and Contract Formation

The presentation of products in the online store does not constitute a legally binding offer, but rather an invitation to place an order.

By completing the checkout process, the customer submits a binding offer to purchase.

👉 A contract is only concluded when:

  • the goods are shipped, or
  • an explicit shipping confirmation is sent via email

Poké Faust reserves the right to accept or reject any order at its sole discretion.

3. Availability and Delivery

All offers are subject to correct and timely self-supply by our suppliers.

If a product is not available, Poké Faust reserves the right:

  • to cancel the order, or
  • to refrain from delivery

Any payments already made will be fully refunded.

4. Prices and Errors

All prices are stated in CHF.

👉 Poké Faust reserves the right to cancel orders in cases of:

  • obvious pricing errors
  • technical issues
  • incorrect product information

In such cases, no valid contract is formed.

5. Payment Terms

Payment must be made in advance using the payment methods provided in the store.

Goods remain the property of Poké Faust until full payment has been received.

6. Shipping and Transfer of Risk

Shipping is carried out via third-party carriers.

👉 Risk transfers to the customer once the goods are handed over to the shipping provider.

7. Preorders (Important)

For preorder items:

  • Delivery dates are non-binding
  • Delays from manufacturers or suppliers may occur
  • Allocations may be reduced

👉 Poké Faust reserves the right to:

  • cancel preorders in whole or in part
  • adjust quantities

There is no entitlement to delivery.

8. Right of Withdrawal / Returns

Returns are accepted within 14 days of receiving the goods.

Conditions:

  • unopened
  • unused
  • in original packaging
  • complete

👉 The following are excluded from return:

  • opened products
  • single trading cards
  • sealed TCG products once opened

9. Liability

Poké Faust is only liable for damages caused by intentional misconduct or gross negligence.

Liability for:

  • delivery delays
  • product unavailability
  • market price changes

is excluded to the extent permitted by law.

10. No Claim for Damages

👉 In cases of:

  • non-availability
  • supply issues
  • order cancellations in accordance with these Terms

there is no entitlement to compensation or cover damages.

11. Governing Law and Jurisdiction

Swiss law applies exclusively.

Place of jurisdiction is Bern, Switzerland.

Before initiating legal proceedings, both parties agree to attempt mediation.
